Terms of Service
These terms govern your use of the open·broadcast managed relay service (the “Service”), operated by [registered entity name] trading as Hunter Valley IT (“we”, “us”), ABN [ABN]. By creating an account or using the Service you agree to these terms.
Last updated: [date]. The Service is in invite-only beta; these terms may change as it matures.
1. The Service
open·broadcast aggregates multiple internet uplinks into a bonded RIST feed and fans it out to your chosen RTMP/RTMPS, SRT and RIST destinations without re-encoding. Relay infrastructure is hosted in Australia. The encoder, receiver and bonding-router software are open source (see Licensing); these terms cover the hosted Service only — self-hosting is governed solely by the software licence.
2. Beta status & availability
The Service is provided during beta on an “as is” and “as available” basis with no service-level agreement or uptime guarantee. Features may change or be withdrawn. We may impose or change capacity, concurrency and bandwidth limits.
3. Accounts & eligibility
You must be at least 18 and provide accurate registration details. You are responsible for activity under your account and for keeping your credentials, stream keys and pairing codes secure. Notify us promptly of any unauthorised use.
4. Acceptable use
You must not use the Service to:
- transmit content you do not have the rights to distribute, or that infringes any third party’s intellectual property;
- transmit unlawful, defamatory, or prohibited content, or content that breaches Australian law;
- attempt to breach, probe or disrupt the Service, other tenants, or the underlying infrastructure, or circumvent capacity or egress limits;
- resell or provide the Service to third parties except as expressly permitted.
We may suspend or terminate accounts that breach this section, with or without notice where necessary to protect the Service or others.
5. Your content
You retain all rights in the audio/video you transmit (“Your Content”). You grant us only the limited licence needed to receive, transport, remux and deliver Your Content to the destinations you configure, and to make short-lived operational recordings where you enable them. We do not claim ownership of Your Content and do not use it to train models or for advertising.
6. Plans, fees & metering
Beta accounts are provided free of charge. Paid plans (billed via our payment processor) may be introduced; where usage-based charges apply (for example egress beyond an included allowance), they will be metered and disclosed before they take effect. You authorise charges for the plan you select and any metered overage.
7. Recordings & retention
Where you enable session recording, recordings are retained only for the period shown in your account and then deleted. You are responsible for exporting anything you wish to keep. See the Privacy Policy for details.
8. Intellectual property & open source
Our first-party software is licensed under AGPL-3.0-or-later; your rights in that software are set out in that licence, not these terms. The open·broadcast name and logo remain ours. See Licensing & source.
9. Disclaimers & liability
To the maximum extent permitted by law, the Service is provided without warranties of any kind. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded. Subject to that, our aggregate liability arising from the Service is limited to the fees you paid in the three months before the event giving rise to the claim (or, for the free beta, AUD 100). We are not liable for indirect or consequential loss, or for lost streams, revenue or data.
10. Suspension & termination
You may stop using the Service and close your account at any time. We may suspend or terminate access for breach of these terms, risk to the Service, or discontinuation of the beta. On termination your right to use the Service ends and associated data may be deleted after a reasonable period.
11. Changes
We may update these terms; material changes will be notified via the Service or by email. Continued use after changes take effect constitutes acceptance.
12. Governing law & contact
These terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that jurisdiction. Questions: [legal contact email].
